BJP leader Priyanka Sharma gets bail after being arrested for morphing TMC’s photo
BJP leader Priyanka Sharma has been granted bail by the Supreme Court on Tuesday after she was arrested by West Bengal police on Monday for sharing an offending meme of Trinamool Congress chief Mamata Banerjee on her Facebook post.
She had allegedly shared a photo in which Banerjee’s face had been photoshopped on the torso of actress Priyanka Chopra’s picture from the MET Gala event held recently at New York, says a report.
Sharma is a BJP Yuva Morcha leader and was arrested under Section 500 of the Indian Penal Code (defamation), Section 66A (offensive content) and 67A (distributing sexually explicit material) of the Information Act.
Sharma approached the Top Court challenging her arrest by West Bengal police. The vacation bench, comprising Justices Indira Banerjee and Sanjiv Khanna, ordered her to tender a written apology at the time of release. The court had earlier asked her to tender an unconditional apology for posting the morphed photograph of the TMC chief to get bail.
However, during the hearing, the bench observed that though freedom of speech is non-negotiable but ‘your freedom of speech ends when it fringes upon others’ rights’.
The bench also observed that since Sharma is a member of a political party, the implications of posting such a picture will be different from those shared by commoners.
